Archer NSG LLC (“Archer” or “we” or “our” or “us”) takes the security and sanctity of data seriously, whether it’s our own data or that of our clients.   We endeavor to act in a professionally reasonable fashion to protect all of the data at Archer regardless of its origin.

This Privacy Statement (“Privacy Statement or “Statement”) sets out the privacy practices for Archer with respect to information, including Personal Data (i.e. information relating to an identified or identifiable natural person), we obtain from and about individuals interacting with Archer directly or indirectly through its websites and/or professional services. All Personal Data that we collect, other than information collected in the employment context, is subject to this Privacy Statement.

  • Considering resumes and applications received by individuals related to employment opportunities with Archer, including all elements of the procedure/process leading up to a potential offer of employment, including but not limited to any requisite background checks. Some job applicant data processing may also be necessary to comply with legal obligations
  • Other purposes disclosed at the time of collection or otherwise compatible with the above & applicable law

In instances where information is transferred to Archer through a client data controller and Archer is acting as the processor, the processing is necessary for the performance of a contract or for our legitimate business interest to provide the requested services to our clients. In these instances, Archer may assist the client data controller in complying with its legal obligations and the Privacy Shield Principles, discussed below in the International Transfers of Your Personal Data section, where applicable.

With Whom We Share Personal Data

Archer may share Personal Data with the following categories of third parties and for the following purposes:

  • Subsidiaries who process Personal Data on behalf of Archer for the purposes of supporting & providing services to our customers
  • Third party service providers contracted to provide services on behalf of Archer for discrete business purposes (i.e. event planning, talent recruiting &/or travel services)
  • Other corporate entities when a business transaction occurs (i.e. merger &/or acquisition)

Archer may disclose Personal Data in special cases when we have a good faith belief that it is necessary to: (a) conform to legal requirements or to respond to lawful requests by public authorities, including to meet national security or law enforcement requirements; (b) protect and defend our rights or property; (c) enforce the website Terms & Conditions; or (d) protect the interests of our users or others.

Retention of Data

We will keep your Personal Data as reasonably necessary to fulfill the purposes for which Personal Data is collected as stated herein: (a) for as long as is necessary for the performance of the contract between you and us, if any; and, (b) to comply with legal and statutory obligation.  Archer is free to delete any and all Personal Data when a decision is made by Archer that retaining such information is not longer necessary.  Additionally, upon written request Archer may also elect to delete Personal Information is deemed appropriate by Archer.

Erasure.

You may request to erase your Personal Data if it is no longer necessary for the purposes for which we have collected it, you have withdrawn your consent and no other legal ground for the processing exists, you objected and no overriding legitimate grounds for the processing exist, the processing is unlawful, or erasure is required to comply with a legal obligation.

Right to lodge a complaint.

You also have the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of your residence, or the location where the issue that is the subject of the complaint occurred.

Right to refuse or withdraw consent.

Please note that in case we ask for your consent to certain processing, you are free to refuse to give consent and you can withdraw your consent at any time without any adverse negative consequences. The lawfulness of any processing of your Personal Data that occurred prior to the withdrawal of your consent will not be affected.

“Do Not Track” Disclosures

When you visit a website (such as Archer’s website), your browser automatically shares certain information with that website, such as your IP address and other device information, which may also be considered Personal Data under applicable laws. Some of this data may also be sent to third-party content providers (for example: advertisers, website analytic companies, etc.) that provide content on the website. At this time, Archer’s website does not respond to Do Not Track beacons sent by browser plugins as there is not yet a common agreement about how to interpret Do Not Track signals from browsers.

By using the website or providing Personal Data to Archer, your Personal Data may be transferred to the United States where Archer is headquartered. Certain third world countries have been officially recognized by the European Commission as providing an adequate level of protection (list available here) Transfers to third parties located in countries outside the European Economic Area (“EEA”) take place using an acceptable data transfer mechanism, such as the EU-U.S. Privacy Shield for transfers to self-certified U.S. organizations, the EU Standard Contractual Clauses, Binding Corporate Rules, approved Codes of Conduct and Certifications or in exceptional circumstances on the basis of permissible statutory derogations.
